Section 01
Definitions
The following definitions apply throughout this Agreement.
Services
All AI-powered tools, software, platforms, websites, and services provided by Thorns Tavern, including 3D model generation, model printing, previews, and related services.
Customer Data
All data, content, prompts, images, designs, or other materials submitted through the Services.
AI Customer Input
Information, data, text, prompts, images, designs, code, or other content submitted or uploaded by you or on your behalf.
AI Customer Output
Content generated by the Services in response to AI Customer Input, including text, images, 3D models, and other output.
Section 02
License Grant
Subject to this Agreement, Thorns Tavern grants the following limited rights.
Use of Services
A limited, non-exclusive, non-transferable, revocable license to use the Services for lawful purposes.
Content rights
You retain ownership of Customer Data. By submitting Customer Data, you grant Thorns Tavern a worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute it solely to provide the Services.
Output use
You may use AI Customer Output for personal, commercial, or educational purposes, subject to this Agreement and applicable law.
Section 03
Acceptable Use
You agree not to use the Services for unlawful, infringing, harmful, malicious, or disruptive activity.
Lawful use
Do not violate applicable law, regulation, or third-party rights.
Third-party rights
Do not infringe the intellectual-property, privacy, or other rights of another person or entity.
Harmful content
Do not create, upload, or distribute harmful, offensive, abusive, or malicious content.
Service integrity
Do not disrupt or interfere with the Services or other users.
Security controls
Do not reverse engineer, hack, or bypass the Services' security, access controls, payment requirements, or technical safeguards.
Section 04
Fees And Payment
Access to the Services may require payment of fees displayed on the website or otherwise communicated to you. Unless explicitly stated otherwise, fees are non-refundable. You are responsible for taxes associated with your use of the Services.
Section 05
Privacy And Data
We take data security seriously. AI Customer Input and AI Customer Output are stored securely, and user uploads are kept confidential. Uploaded images and 3D models, including content submitted through Image to 3D, are not used to train our models without explicit consent.
Training sources
Training models are sourced from publicly available, freely licensed resources or models obtained through legally authorized channels. Private or proprietary user models are not used for training.
General data use
Customer Data may be used to improve the Services, debug issues, and conduct research in compliance with applicable law, but only in ways that do not expose, share, or compromise user assets.
Section 06
Intellectual Property And Generated Assets
All intellectual-property rights in the Services, including software, algorithms, and underlying models, remain the property of Thorns Tavern or its licensors. You are responsible for ensuring that AI Customer Input, including uploaded reference images, does not infringe third-party rights.
Premium Plan ownership
Premium Plan users retain full private ownership of assets created using Thorns Tavern when those assets are not published publicly to the Thorns Tavern community and the materials used to create them do not infringe another party's copyright. This includes uploaded source images.
Free Plan license
Free Plan models are licensed under CC BY 4.0. Attribution should state: "Model created with Thorns Tavern - CC BY 4.0 License."
Commercial use
Assets may be used in commercial projects when the user complies with law and third-party rights. Free Plan users must include the CC BY 4.0 attribution in the project description.
Selling on other platforms
Premium Plan users may distribute and sell their models without attribution. Free Plan users may sell models but must include the CC BY 4.0 attribution on the product or listing page.
Subscription cancellation
Models created while a user was a Premium Plan member remain that user's property and remain private after cancellation; they do not automatically revert to CC BY 4.0.
Section 07
Third-Party Content
The Services may include third-party content, tools, or integrations. Thorns Tavern does not control those services and is not responsible for their availability, quality, or compliance.
Section 08
Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind. Thorns Tavern does not guarantee the accuracy, reliability, or suitability of AI Customer Output for any purpose.
Section 09
Limitation Of Liability
To the maximum extent permitted by law, Thorns Tavern is not liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the Services or this Agreement.
Section 10
Indemnification
You agree to indemnify and hold harmless Thorns Tavern, its affiliates, officers, and employees from claims, damages, losses, or expenses arising from your use of the Services, violation of this Agreement, or infringement of third-party rights.
Section 11
Termination
Either party may terminate this Agreement by written notice if the other party breaches a material term and does not cure the breach within thirty (30) days.
Section 12
Governing Law And Dispute Resolution
This Agreement is governed by the laws of the State of California. Disputes will be resolved through binding arbitration in California unless applicable law requires otherwise.
